This Privacy Notice explains how we, Lirio Games B.V., acting as My Horsez, domiciled at Lange Amerikaweg 55, 7332 BP Apeldoorn and registered with the Dutch Chamber of Commerce under registration number 96985933 (“My Horsez” or “we”) collect and process your personal data when interacting with our website [https://www.myhorsez.com/] and/or using our mobile app (collectively: the “Services”). This Notice also informs you about how we protect your personal data and the rights and options you have to control your data.

Please read this notice carefully and regularly consult it when using our Services, as it may be necessary for us to amend this notice from time to time. We aim to update you in the event we make substantive changes to the way we process your personal data, for example by providing a notice in our Services or sending you a notification via email.

 

1. What types of personal data do we collect and process?

By “personal data” in this privacy notice, we mean all data that can be directly or indirectly traced back to you as an individual. Depending on how you use our Services, we collect and process data that you ask us to process or data that we collect through other means. Please note that there may be third parties that also collect your personal data, such as third-party app store providers you may use to access our Services. We are not responsible for this data collection and refer you to such respective third-party privacy notices for information on how such third parties collect, process and share your personal data.

3. Do we process personal data of minors?

Our Services are only available to individuals aged 13 or older. We do not knowingly collect or process personal data within our Services from minors aged below 13. If we learn we have collected or received personal data from anyone under the age of 13, we will delete such data unless we have explicit consent from parents or legal guardians to process such data.   • Public authorities, justice and law enforcement, fiscal authorities and other authorities assigned with investigative powers or public authority, to the extent we are legally required or have legitimate interests to do so.

We do not sell or share identifiers, internet or similar network or activity data with our third-party marketing partners, nor do we “sell” or “share” the personal information of known minors.

 

5. International transfer of your personal data

We try to process your data within the European Economic Area (EEA) as much as possible. Sometimes it is necessary to transfer your data outside the EEA to a country which does not provide the same level of data protection, for example if one of our third-party service providers is located outside of Europe. When we transfer your data outside the EEA, we ensure that this is done in accordance with applicable data protection laws and that the protection of your data is adequately safeguarded, for example by ensuring we have agreements in place based on the EU standard contractual clauses for international transfer of personal data. 6. The storage and security of personal data

We have taken appropriate technical measures to as much as reasonably can be expected secure your personal data against loss or other forms of unlawful processing. These measures ensure a security level that is appropriate to the data we process and the industry we’re operating in. These security measures include regular software updates to our server (for example security and firewalls updates), encrypted storage of your passwords on our servers and an SSL connection to encrypt website traffic. Please note, however, that due to the nature of our Services, we cannot guarantee that your personal data will at all times be protected, secured or available.

 

7. Retention period of your personal data

We do not process or store your personal data longer than necessary for the purpose for which it was received. As a general rule, we will retain your personal data for the duration of your interaction with our Services (meaning until you terminate your user account), unless a shorter retention period is required under applicable laws. After termination of your account, we will retain some of your personal data for an additional period of maximum 3 years, unless you explicitly instruct us to delete all your personal data sooner. PLEASE NOTE that once you have instructed us to delete your personal data, all your account history data will be lost and you will no longer be able to retrieve your account after 60 days following such request.

We will anonymize your personal data after deletion of your account and your request to delete your personal data. Such anonymization process is irreversible after 60 days. We may keep some of your personal data even after a deletion request if we have a legal basis to do so. For example, we can retain your personal data for the period of time that enables us to:

  • fulfil our legal obligations, including legal retention periods;
  • initiate, investigate or defend against legal claims;

If we are the data controller, we aim to process your request within 4 weeks. If we are only the data processor, we will refer your request to the data controller, who will then handle your request.

Authorized agents wishing to exercise rights on behalf of an individual may use the submission method noted above. We will honour a request from an authorized agent provided if the agent can provide a written authorization from the individual to the authorized agent to act on their behalf, we are able to verify the individual’s identity and the agent submits proof of authorization.
